1. Who these terms are between
These Terms & Conditions (“Terms”) govern your use of the Cosmic Monkey website and, once available, the Cosmic Monkey analytics product (together, the “Service”). They are a contract between you (or the entity you represent) and the company operating Cosmic Monkey, an entity registered in India. If you do not agree with these Terms, do not use the Service.
2. The Service
Cosmic Monkey is a web analytics and revenue-attribution tool. It records traffic and event data from websites you connect, and — where you connect a Razorpay or Cashfree account — associates completed payments with the marketing channel and session that preceded them. The Service is currently pre-launch; features described on this website are planned, not guaranteed, and may change.
3. Accounts
You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. You must be at least 18 years old and able to enter into a binding contract.
4. Acceptable use
You agree not to:
- use the Service to collect data from websites you do not own or control;
- upload personal data of end users beyond what is needed for analytics, or any special-category personal data;
- attempt to break, overload, reverse-engineer or circumvent access controls of the Service;
- resell or sublicense the Service without written permission.
5. Payments and billing
Paid plans are billed in Indian rupees (INR) in advance on a monthly basis. Payment processing is handled by third-party processors (including Razorpay and Cashfree); your use of that processing is subject to their terms. Applicable Goods and Services Tax (GST) will be added and shown on invoices issued from our Indian entity. Except where required by law, fees are non-refundable; you may cancel at any time and your plan will remain active until the end of the current billing period.
6. Free trial
Plans may include a 14-day free trial. If you do not cancel before the trial ends, the plan converts to a paid subscription at the rate shown at signup.
7. Your data
You retain ownership of the data you and your end users generate through the Service. You grant us the licence needed to host and process that data to provide the Service. Our handling of personal data is described in the Privacy Policy.
8. Service availability and changes
We aim for high availability but do not warrant that the Service will be uninterrupted or error-free. We may modify or discontinue features with reasonable notice for material changes.
9. Warranties and liability
The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Service is limited to the amount you paid for the Service in the three months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential losses, or for lost profits or revenue.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms. On termination, your right to use the Service ends and we may delete your data after a reasonable retention period.
11. Governing law
These Terms are governed by the laws of India. The courts at our registered office location will have exclusive jurisdiction, subject to any non-waivable rights you have as a consumer.
